1. Introduction

Welcome to Mind the Merch, an online marketplace connecting customers with independent artists and bands through www.mindthemerch.com. By accessing the Website or making a purchase, you agree to the following Terms and Conditions (“Terms”). These Terms apply to both consumers and business vendors. If you do not agree, do not use our Website.

2. Key Definitions

  • “We”, “us”, “our” refer to Mind the Merch Ltd, registered in the United Kingdom.

  • “You”, “your” refers to a customer or user of the Website.

  • “Vendor” or “Artist” refers to an individual or entity using our platform to sell merchandise.

  • “Website” refers to www.mindthemerch.com.

  • “Products” means any merchandise offered for sale by artists on our Website.

3. How Our Marketplace Works

Mind the Merch is a facilitator and marketplace platform. We host product listings for independent artists and manage payments on their behalf.

Here’s how our process works:

  • Payment is collected by Mind the Merch at checkout on behalf of the Vendor.

  • Order information (item details, amount, and customer contact info) is immediately forwarded to the Vendorfor fulfilment.

  • Customers will receive a follow-up email confirming the purchase, with artist/band contact details should direct communication be needed.

  • The Vendor is solely responsible for shipping the item to the customer.

  • Vendors are required to submit a valid tracking number within a reasonable time frame.

  • Mind the Merch holds payment until a tracking number is received and releases funds 7–10 days after confirmed delivery.

  • Disputes are handled by Mind the Merch’s customer support team, which may investigate and mediate between the customer and Vendor. We reserve the right to make the final decision in any resolution.

4. Order Confirmations & Communication

Customers will receive an automatic order confirmation with:

  • Date of purchase

  • Product ordered

  • Amount paid

  • Estimated fulfilment times
    Customers will then receive a second email with:

  • Vendor contact details

  • A reminder that fulfilment is handled by the artist/vendor

5. Shipping and Fulfilment

  • Shipping times are estimated by each Vendor and displayed on product pages.

  • Mind the Merch is not liable for delays caused by vendors or third-party carriers.

  • Risk of loss passes to the customer once the Vendor dispatches the product to the shipping provider.

6. Business-to-Business Terms (Vendors & Artists)

This section applies to Vendors/Artists listing merchandise on the platform.

Vendor Obligations:

  • Vendors agree to ship items in a timely manner, matching the descriptions and standards set in their listings.

  • Vendors must submit a tracking number within a reasonable timeframe (no later than 7 days post-sale).

  • Vendors are responsible for handling faulty items, incorrect orders, or delayed shipments.

  • All returns/refunds must be handled per applicable UK consumer law.

  • Vendors agree that Mind the Merch may withhold payment until tracking is confirmed and delivery is completed.

  • Commission fees will be deducted before funds are transferred.

  • Vendors must comply with VAT requirements and legal trading standards in the UK.

Mind the Merch Rights:

  • We reserve the right to remove vendors or listings that breach these Terms, receive significant complaints, or fail to meet our fulfilment standards.

  • We may hold payments in the case of active disputes, pending investigation.

  • Repeated policy violations may result in account termination.

7. Dispute Resolution

Customers and vendors agree to first attempt to resolve any dispute via our customer support team.
If a resolution cannot be reached:

  • Mind the Merch may act as the final mediator and decision-maker.

  • For significant claims, parties may opt for binding arbitration under the Chartered Institute of Arbitrators in the UK.

8. Intellectual Property

All branding, site design, copy, and digital assets are the property of Mind the Merch or its licensors.
Use of this content without permission is strictly prohibited.

9. Limitation of Liability

  • Mind the Merch is not liable for any indirect, incidental, or consequential loss.

  • Our total liability is limited to the amount paid for the product in question.

  • Vendors are solely responsible for any claims related to faulty goods or late delivery.

10. Account Suspension & Termination

We reserve the right to suspend or ban any user or vendor for:

  • Harassment or abusive conduct

  • Breach of these Terms

  • Attempted fraud or chargebacks
    Appeals can be made via our contact page.

11. Changes to These Terms

We may amend these Terms at any time. Updates will be posted on this page. Continued use of the site implies acceptance.

12. Governing Law

These Terms are governed by the laws of the United Kingdom.
All parties agree to the jurisdiction of UK courts or arbitration bodies.
